  3. What the hell kind of “court” refuses to consider relevant evidence when making a decision?

  4. Just to be clear, arbitration is always final, pretty much everywhere. So it makes sense that the CAS did not review the case it already decided.

    That said, you can appeal CAS awards to the Swiss Federal courts, and USA Gymnastics intends to do just that.

    Switzerland being a hub of international business, has an explicit provision in its law allowing the appeal of arbitration if new evidence comes to light. In [Article 190a of the PILA:](https://www.fedlex.admin.ch/eli/cc/1988/1776_1776_1776/en)

    >A party may request a review of an award if:

    >a) It has subsequently become aware of significant facts or uncovered decisive evidence which it could not have produced in the earlier proceedings despite exercising due diligence; the foregoing does not apply to facts or evidence that came into existence after the award was issued;

    >The request for a review must be filed within 90 days of the grounds for review coming to light.

    The court would then order the CAS to re-hear the case including the new evidence. I think the only way the appeal fails is if the court rules that due diligence would have found this evidence before the proceedings.

  5. How are they going to go back after review, admit they were wrong, then come back again now and say they were wrong but you were 4 seconds too late on catching our mistake? That just seems so stupid.

  6. It’s funny because the rightful 3rd place finisher still won’t get a medal. This whole situation is screwed up beyond belief.

  9. Im not sure why the current system relies so heavily on real-time, subjective judging while still using a rigid bureaucracy that adds complication and user error.

    Gymnastics is an objective competition. So why aren’t they using multiple cameras to catch mistakes and an independent group of officiating staff making sure difficulty and deductions are accounted for correctly?

    It seems there’s always some issue with the incorrect points being awarded, deductions being missed or added incorrectly.

The judges fucked up obviously, but Romania is very much to blame here and I hate the people defending them when their “we’re fine if Jordan also got a bronze” is such an obvious PR move after they moved like a snake to steal her medal. It’s on them that they brought up the “60 seconds to challenge if you go last” rule and they knew where that would lead.

  13. Sucks for both athletes to have to deal with this because the IOC fucked uo and can’t admit that.

  14. The worst part of all this is the athlete getting the medal is the only one who doesn’t have an argument for it. Chiles got deducted a tenth on her difficulty score and the other Romanian gymnast got deducted for stepping out when she never stepped out. If either of these mistakes were judged properly, the gymnast who currently has the bronze medal would be off the podium

  15. It’s the (generally) small window when the whole world cares a lot about gymnastics. Why be so ridiculous with the rules. Give em both Bronze. Damaging publicity far exceeds the value of the medal already

  16. It will be interesting to see if the Romanian gymnast competes in 2028. I’m guessing the home crowd won’t receive her well.

  17. I’m not well versed on gymnastics, I just casually watch it, but here’s my opinion on this.

    All three athletes are the victims. Jordan, Anna, and Sabrina are going through unnecessary administration fighting that it’s probably soured their experience. I think the best thing would have been to share the bronze and NOT strip Jordan of her medal as Romania suggested. Not sure why the US refused this suggestion, prob cause they thought they could use their weight to get their way, but it massively backfired and NOW Jordan will be stripped of the medal.

    They could have accepted this tie WHILE appealing for a final decision, but I’m not sure why the US didn’t take this route. The athletes shouldn’t be punished for administrative errors, but that’s what is happening here.

    Again, I’m just a casual in gymnastics and it’s my opinion. Both Romanian Olympians, Anna and Sabrina, and Jordan deserve better.

  19. I hope this doesn’t crush her and she keeps on competing and getting better, shame on the Olympic community for being power hoarders.
