Is this normal?



I completed apartment handover on 30th August, everything was checked and there was no indication that anything was amiss. In previous apartments I was usually refunded my caution deposit ~2weeks after handover, however my current landlord indicated 6-12months to refund me. Is this normal? If not what do you advice I do, I really need the money.

  1. 6-12 months is legal and relatively normal, since it can be kept for up to 6 months and then after that until the Nebenkostenabrechnung comes in and all bills have been settled.

  2. Unfortunately yes, this is normal. 6 months is basically the legal maximum* they can keep all of the deposit, but they can keep part of it for longer until all utilities are settled.

    (*The law does not define a legal maximum, but this is the number that courts often have come up with.)

  3. Yes, it doesn’t look like a fraude (yet) , however sometimes it helps to ask friendly (while giving them the Bank account) and of course I would ask every second month again.
