I left the university due to my health, I will not continue my education and I'm not a student at university anymore.
I deregistered from the city and closed my bank account too.
I’ll return to my home country in November.
I went to the dormitory office two days ago and stated that I want to leave the dormitory in November.
The contract starts on 01.09.2024 and ends on 31.03.2025.
However, the worker there said that according to the contract I have to pay two months' rent, and if I don’t send them “Kündigungsformular” by November 5th, I have to pay 3 months' rent.
But the contract says that they can cancel if I am not a enrolled student.
When a friend of mine went to the dormitory office, they told him to find someone who wants to leave his room. I also paid the deposit (Kaution) in cash, but they said they couldn’t give it back in cash.
I am very confused because they say different things every time.
How can I cancel the contract and get the deposit back?
What happens if I don’t pay the rent and just leave?
Is there anyone who can help me with this?

So this is how I understand the cancellation policy:
* You have three months notice, so if you cancel now you have to pay for November, December and January. If you miss November 5th, you will also have to pay for February.
* You can shorten this time by a month (only pay November and December) if you find them a new tenant by November 18th.
As for getting the deposit back: they are not obligated to pay it out in cash and they may withhold it for multiple months. If you don’t have a german bank account anymore, you will probably need someone with one to receive the money for you.
Not paying the rent and just leaving will result in you collecting rent debt, which is eventually sent to collections. The debt collection company will put a bunch of horrendous fees on it. If you ever return to Germany, you will have substantial debt.
You should immediately send them a cancellation letter through registered mail (“Einschreiben”) to avoid paying for more months. Then you should try to find a tenant for them before you leave. If you can’t, just take the loss. You will also need to ask someone you trust to receive the deposit for you. Make sure you tell the Studierendenwerk that you no longer have a bank account and that you want them to transfer it to a different person.
Where does the contract say you can cancel without notice if you’re not an enrolled student anymore?
If you leave and not pay your mainly a dick. You’re an adult, you signed a contract. None of this is a surprise.
How you can cancel? Ideally in writing. There’s forms online, you just have to fill them out.
well… first they wont give you the Kaution back, in case you leave without paying the rent. secondly they can keep your Kaution for up to 6 months in case they discover damages etc. after you left and they dont know the Nebenkosten for your stay yet (for that they can keep up to one month rent until the end of next year), they will get the invoices for the Nebenkosten over the course of next year and then send you a “bill” detailing the costs and transfere the rest of the money.
they can cancel the contract, since you are no longer a student, but the contract states, that you would still have to pay for two months. them cancelling the contract, doesnt mean that you dont have to pay.
