There is no debate; biscuits by definition are made without using any raising agent … The **sponge** in Jaffa **cakes** are made using a raising agent; ergo they’re cakes.
Does that make a cake sized biscuit a cake? Of course not.
They are small cakes. They go hard when they get stale. Biscuits go soft.
My parents once bought me 20 tubes of Jaffa cakes and stacked them on a plate for my birthday, with candles in them like this.
It’s the only birthday I ever really fondly look back on
Then why do they not soften over time?
If I get one cake for each candle I’m good with that.
I think my main criticism here is size, not the cake status. How are we going to cut this up at my birthday party?

I didn’t realise they made biscuits out of cake, I’ve seen it all now.
Legally they are cakes. When they go off, they go hard instead of soft.
